Daily Icebreakers (the “Service”) is operated by Taim Technologies, LLC (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms & Conditions. If you do not agree, please do not use the Service.
The Service
Daily Icebreakers gives teams and groups one shared conversation question per day. You can create a team, invite members, add your own questions, and track which questions your team has already used.
Your account
You sign in with a Google account. You are responsible for keeping access to that account secure and for all activity that happens under your account. You must be old enough to form a binding contract in your jurisdiction, and at least 13 years old, to use the Service.
Your content
You keep ownership of the questions, team names, and member names you add (“Your Content”). You grant us a limited license to store, display, and process Your Content solely for the purpose of operating the Service for you and your team.
You agree not to submit content that:
- Is unlawful, harassing, hateful, or threatening
- Infringes someone else's intellectual property or privacy rights
- Contains sensitive personal information about another person without their consent
- Attempts to disrupt, overload, or gain unauthorized access to the Service
Anyone on your team can see the questions and member names associated with that team. Please use good judgment about what you add, and remember that icebreaker questions should be safe for everyone on the team to answer.
Teams and administrators
Whoever creates a team can add or remove members, add or delete questions, and change team settings. If you join a team you did not create, the team's administrators can see and manage the team data described above.
Acceptable use
Do not misuse the Service. That includes reverse engineering it, scraping it, reselling access to it, or using it to send spam or malware. We may suspend or terminate accounts that violate these Terms.
Availability and changes
We may change, suspend, or discontinue any part of the Service at any time. We may also update these Terms. If we make material changes, we will update the “Last updated” date above. Continuing to use the Service after changes take effect means you accept the updated Terms.
Cancellation
You may stop using the Service at any time. You can request deletion of your account and associated data as described in our Privacy Policy.
Disclaimer of warranties
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
Limitation of liability
To the fullest extent permitted by law, Taim Technologies, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or profits, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim, or one hundred U.S. dollars (US$100).
Indemnification
You agree to indemnify and hold harmless Taim Technologies, LLC from any claims, losses, or expenses arising out of Your Content, your use of the Service, or your violation of these Terms.
Governing law
These Terms are governed by the laws of the District of Columbia and applicable United States federal law, without regard to conflict-of-laws principles. You and Taim Technologies, LLC agree that the state and federal courts located in Washington, DC will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.
